KidsLife — Terms of Service

1. Acceptance of Terms

By creating an account or using the KidsLife application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

KidsLife is a daycare management application that enables daycare operators, staff members, and parents/guardians to:

• Manage child profiles and classroom assignments
• Share daily activity reports (meals, naps, notes, incidents)
• Share photos of daily activities
• Communicate via in-app messaging
• Manage calendar events

The App is designed for use by adults. Children do not directly interact with the App.

3. User Accounts & Roles

3.1 Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials.

3.2 User Roles

• Owner: Creates and manages a daycare, has full administrative privileges
• Admin: Manages staff, children, and daycare operations
• Staff: Views and creates activity reports for assigned children
• Parent: Views activity reports and photos for their own children

3.3 Account Responsibility

You are responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized use.

4. Acceptable Use

You agree NOT to:

• Use the App for any unlawful purpose
• Share, distribute, or misuse photos or information about children outside the App
• Attempt to access data from daycares you are not authorized to access
• Upload inappropriate, offensive, or harmful content
• Interfere with or disrupt the App's functionality
• Reverse engineer, decompile, or disassemble the App
• Use the App to harass, bully, or threaten any person
• Create multiple accounts for fraudulent purposes

5. Children's Data & Parental Consent

5.1 COPPA & GDPR Compliance

The App complies with the Children's Online Privacy Protection Act (COPPA) and the General Data Protection Regulation (GDPR). Parents must grant consent through their account settings before activities can be posted for their children.

5.2 Data Processing Roles

• Daycare operators are the data controllers responsible for the children's data they enter
• KidsLife acts as a data processor, processing data on behalf of the daycare operator
• Both parties share responsibility for ensuring data is handled in compliance with applicable laws

5.3 Daycare Operator Obligations

Daycare operators using the App agree to:

• Ensure parents have granted consent via the App before posting activities
• Ensure staff members are trained on appropriate data handling
• Respond to parental requests regarding their children's data
• Comply with all applicable child privacy laws in their jurisdiction

6. Intellectual Property

The App, including its design, code, logos, and content, is owned by KidsLife and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without our prior written consent.

User-generated content (activity reports, photos, messages) remains the property of the respective users and daycare operators.

7. Subscription & Billing

7.1 Service Tiers

The App offers tiered service plans with varying limits on children, staff, storage, and features. Details of current plans are available within the App.

7.2 Free Tier

The free tier is provided as-is with specified limits. We reserve the right to modify free tier limits with reasonable notice.

7.3 Paid Tiers

Paid subscriptions are billed monthly or annually. You may cancel at any time, and your subscription will remain active until the end of the current billing period.

8. Data Retention & Deletion

8.1 Account Deletion

You may delete your account at any time through the App's Profile settings.

8.2 Daycare Deletion

When a daycare owner deletes their daycare, all associated data is permanently deleted, including children's records, activities, classrooms, events, and conversations.

8.3 Data Deletion Requests

Parents may request deletion of their child's data by using the "Request Data Deletion" feature in the App or by contacting us at privacy@kidslife.app.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount paid by you for the App in the 12 months preceding the claim
• We are not responsible for the actions of daycare operators, staff, or parents using the App

10. Indemnification

You agree to indemnify and hold harmless KidsLife from any claims, damages, or expenses arising from your use of the App, violation of these Terms, violation of any applicable law, or content you upload or share through the App.

11. Service Modifications

We reserve the right to modify, suspend, or discontinue the App at any time with reasonable notice.

12. Termination

We may terminate or suspend your account if you violate these Terms, engage in fraudulent or illegal activity, misuse children's data or photos, or fail to maintain required parental consents.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which KidsLife operates, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms shall first be addressed through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

15. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes through the App or via email. Continued use of the App after changes constitutes acceptance of the updated Terms.
